General Conditions for Sales
Purpose
These General Terms and Conditions of Sale (GTC) define the terms and conditions of use of the online software GATTACA GEOMARKETING (hereinafter referred to as "the Software"), operated under license by GATTACA SOFTWARE SAS (hereinafter referred to as "the Company"), as well as the rights and obligations of the parties in this context.
Acceptance of the T&Cs
Any subscription or use of the Software implies full and complete acceptance of these General Terms and Conditions. The user acknowledges having read the General Terms and Conditions and accepts them without reservation.
Description of the Software
GATTACA GEOMARKETING is an online geomarketing software for professionals, allowing the visualization and analysis of geographic data for marketing and strategic purposes.
Access to the Software:
Access to the Software is possible after subscribing to a subscription or a license. The Company reserves the right to refuse access to the Software to any user who does not comply with these General Terms and Conditions.
Subscription and Pricing
Subscription and license rates are available on the Company's website and are exclusive of tax. Current VAT applies in addition. Rates may be changed at any time by the Company, subject to notification to users at least one month before their application. Subscriptions are payable in advance and are non-refundable.
Payment Terms
Payments are made by direct debit after validation of the account by our financial department. In the event of non-payment, the Company reserves the right to suspend access to the Software until full payment of the amounts due.
Duration and Termination
The subscription is concluded for a fixed term renewable by tacit agreement. The user may terminate his subscription at any time by giving 30 days' notice. In the event of a breach of the General Terms and Conditions, the Company may terminate the subscription without notice or compensation.
User Responsibilities
The user agrees to use the Software in accordance with its intended purpose and the laws in force. He is solely responsible for the data he integrates and uses in the Software, as well as the results obtained. The Company cannot be held responsible for the use made by the user of the data provided by the Software.
Intellectual Property
The Software and all of its components (texts, images, logos, etc.) are the exclusive property of the Company. Any reproduction, representation, modification, publication, transmission, distortion, in whole or in part, of the Software or its contents is strictly prohibited.
Confidentiality
The Company undertakes to protect the confidentiality of the user's data and to use them only in the context of operating the Software. Customers' personal data is stored encrypted on servers based in France. Beyond reasonable precautions, the Company cannot be held responsible for a data leak. The personal data collected is processed in accordance with the Company's privacy policy.
Telephone Support
Telephone support is free for users, within the limit of reasonable use defined by a maximum call time less than double the median call duration over a month for all users. The Company reserves the right to suspend this free support if a user exceeds this limit, considering unreasonable use.
Availability and Maintenance
The Company strives to ensure the availability of the Software to the extent possible. However, it cannot guarantee continuous and uninterrupted availability due to possible maintenance operations, updates or technical failures.
Limitation of Liability
The Company shall not be liable for any indirect damages resulting from the use or inability to use the Software, including loss of profit, data or other intangible losses
Force Majeure
The Company shall not be held liable for the failure to perform any of its obligations in the event of force majeure, understood as any external, unforeseeable and irresistible event.
Modification of the T&Cs
The Company reserves the right to modify these T&Cs at any time. The modifications will be applicable as soon as they are posted online on the Company's website. The user is recommended to consult the T&Cs regularly.
Applicable Law and Disputes
These General Terms and Conditions are subject to French law. In the event of a dispute, the parties undertake to seek an amicable solution before resorting to the competent courts. The competent court is located in Mulhouse.
